I am P.C. 1837 Ackland of the Avon and Somerset Constabulary, currently stationed at Trinity Road Police Station.

At 16:20 hours on Saturday, 20th July 2022, I was in full uniform when I was requested to attend St Augustine's Parade following an alleged assault at the location.

Upon arrival, I could see a male lying on the pavement and road who was being treated by members of the public. I spoke with P.C. 1922 Pitts, who was already at the scene, and he stated that the injured party had been hit and had fallen to the ground. The offender had remained at the scene and had been witnessed carrying out the attack. The offender was believed still to be at the scene and was standing with P.C. 1876 Merrydew.

At 16:34 hours, I approached the male, who I now know to be John Jones, and said:

"I'M ARRESTING YOU ON SUSPICION OF ACTUAL BODILY HARM OF THE MALE LYING IN THE ROAD. YOU HAVE BEEN IDENTIFIED BY WITNESSES AS HAVING HIT THE MALE."

I cautioned Jones, who replied:

"IT'S BEEN A BAD DAY. I SHOULDN'T HAVE HIT HIM."

Jones was not handcuffed and was transported to Trinity Road Police Station, where his detention was authorised; SE/5834/07 refers.

At 20:13 hours, I conducted a tape-recorded interview with Jones. At 20:39, the interview was concluded. I produce the interview tapes as 1837/JMCA/01 and the record of the taped interview as 1837/JMCA/02.

Later that evening, Jones was released on police bail.

At 15:27 hours on 11th September 2022, Jones re-attended Trinity Road Police Station, where I charged him with common assault and Assault Occasioning Actual Bodily Harm on Charles Hamilton-Smith.

I cautioned Jones, who made no reply.

Jones was released on police bail to attend Bristol Magistrates' Court.
